Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of PlayStory, including our mobile applications, web services, and any related software (collectively, the “Service”), provided by ILLUSION Tech Limited (“ILLUSION”, “we”, “our”, or “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to create an account. If you use the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

3. Your Content

“Your Content” means any video, story, comment, or other material you upload, submit, or transmit through the Service. You retain all ownership rights in Your Content.

By submitting Your Content, you grant ILLUSION a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify (for technical purposes such as transcoding and thumbnail generation), distribute, publicly perform, and publicly display Your Content solely for the purpose of operating, providing, and improving the Service. This license ends when you delete Your Content from the Service, except where we are legally required to retain it or where it has already been shared with other users who retain the right to view it.

You represent that you own Your Content or have all necessary rights to grant the license above, and that Your Content does not infringe the rights of any third party.

4. Acceptable Use

You agree not to use the Service to:

• upload content that is unlawful, infringing, defamatory, obscene, or harmful to minors;
• impersonate any person or misrepresent your affiliation;
• harass, threaten, or harm other users;
• introduce malware, attempt to gain unauthorized access, or interfere with the Service;
• collect personal information about other users without their consent;
• scrape or otherwise extract data from the Service except as expressly permitted by us;
• use the Service for any commercial purpose not expressly authorized.

5. Content Moderation

We may, at our sole discretion, remove or restrict access to any content that we determine, in good faith, violates these Terms or applicable law. We may also limit, suspend, or terminate access for users who repeatedly violate these Terms.

6. Intellectual Property

The Service, including its visual interface, graphics, design, code, and software, is owned by or licensed to ILLUSION and is protected by copyright, trademark, and other intellectual property laws. Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, or lease any part of the Service.

7. Subscription, Paid Features, and Billing

Some features of the Service may be offered for a fee. If you purchase a subscription or other paid feature, you agree to pay all applicable fees and taxes. Unless otherwise stated, fees are non-refundable. We may change prices with reasonable advance notice.

8. Third-Party Services

The Service may integrate with or link to third-party services (such as Apple Sign in with Apple). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if continued provision of the Service to you would expose ILLUSION to legal risk. On termination, the rights granted to you under these Terms will end, but provisions that by their nature should survive termination (including ownership, disclaimers, and limitation of liability) will remain in effect.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

11. Limitation of Liability

To the maximum extent permitted by law, ILLUSION will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim or (b) USD 100.

12. Indemnification

You agree to indemnify and hold ILLUSION and its affiliates harmless from any claim or demand arising out of Your Content, your use of the Service, or your violation of these Terms or any law or third-party rights.

13. Governing Law and Disputes

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict of laws rules. Any dispute arising out of or in connection with these Terms will be submitted to the exclusive jurisdiction of the courts of Hong Kong.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you (for example, by email or in the Service) before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
